Terms of Use for Photo and Video Submissions

Thank you for considering submitting a photo or video to Big Kids Pants (BKTP Ltd.). By submitting your content, you agree to the following terms and conditions:

1. Ownership and Rights

  • Ownership: By submitting your photo(s) and/or video(s) ("Content"), you grant BKTP Ltd. an irrevocable, perpetual, royalty-free, worldwide, and non-exclusive license to use, reproduce, distribute, display, and create derivative works of your Content in any media now known or later developed.
  • Transfer of Rights: The Content becomes the property of BKTP Ltd. upon submission. BKTP Ltd. may use the Content for promotional, marketing, advertising, and any other business purposes.

2. Privacy and Identifying Information

  • Anonymity: BKTP Ltd. agrees not to use any identifying details, including but not limited to faces, names, or other personal information of the child or the submitter, unless explicitly agreed upon by both parties.
  • Content Display: Your Content may be used on social media, websites, emails, and other marketing channels managed by BKTP Ltd.

3. Content Standards

  • Originality: You affirm that the Content submitted is your original work, and you own all rights to the Content or have obtained the necessary permissions from the rightful owners to submit the Content under these terms.
  • Appropriateness: You confirm that the Content is appropriate, does not contain any offensive material, and complies with all applicable laws and regulations.

4. Compensation

  • Reward: If BKTP Ltd. uses your Content, you will receive one pair of any of our briefs-style training or incontinence pants, plus free shipping. If your submission is not selected for use, you will receive a $10 voucher for your next order (one voucher per customer).
  • No Further Compensation: Apart from the reward stated above, you agree that no further compensation, royalties, or payments are due to you from BKTP Ltd. for the use of your Content.

5. Liability and Indemnity

  • Liability: BKTP Ltd. is not responsible for any claims, demands, or damages arising out of your submission of Content. You agree to indemnify and hold harmless BKTP Ltd. from any third-party claims related to the Content.
  • No Guarantee of Use: Submission of Content does not guarantee that your Content will be used by BKTP Ltd.

6. Revocation

  • Revocation of Rights: Once submitted, you cannot revoke the rights granted to BKTP Ltd. under these terms.

7. Amendments

  • Modifications: BKTP Ltd. reserves the right to amend these terms at any time without prior notice. Any changes will be communicated through an updated version of these terms on our website or other relevant channels.

8. Governing Law

  • Jurisdiction: These terms shall be governed by and construed in accordance with the laws of New Zealand, and any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

By submitting your Content to BKTP Ltd., you acknowledge that you have read, understood, and agree to these Terms of Use. If you do not agree with these terms, please do not submit any Content.
